本中心很榮幸邀請到香港中文大學法律學院李治安教授,於本(5)月27日(一)蒞臨本院霖澤館1301室演講:Unwinding NFTs in the Shadow of IP Law, 從智慧財產的觀點來看非同質化代幣。活動開場由政治大學法學院沈宗倫教授致上歡迎詞、成功大學法律學系許曉芬教授主持,並由清華大學科技法律研究所李紀寬助理教授, 洪淳琦助理教授, 臺科大專利所李姿儀助理教授, 黃泰然助理教授 與 台灣科技產業法務經理人協會蔡文宜博士/監事 與談。
李教授首先分享撰寫本篇文章的動機,並與先前有關NFT是否應直接或類推適用「物權」、「有體財產」上之關係有所疑問,並以相關論點支持認為其其實與「無體財產」、例如智慧財產體系其實有極大關連或有類似之處。演講後半部分,李教授亦和同學分享學術寫作在題目構思、分析過程與遇到瓶頸時的可以處理的方式,並以他自身經驗勉勵同學。
CLTE was honored to invite Professor Jyh-An Lee, from the Faculty of Law at The Chinese University of Hong Kong to give a lecture on May 27, 2024 (Monday) at Room 1301, Tsai Lecture Hall. The topic of the lecture was "Unwinding NFTs in the Shadow of IP Law," examining non-tangible tokens from the perspective of intellectual property.
The event began with a welcome address by Professor Chung-lun Shen from the Faculty of Law at National Chengchi University. The session was moderated by Professor Hsiao-Fen Hsu from the Department of Law at National Cheng Kung University. The discussion also featured Assistant Professor Li Ji-Kuan and Assistant Professor Hong Chun-Chi from the ILST at National Tsing Hua University, as well as Assistant Professor Li Tzu-Yi and Assistant Professor Huang Tai-Ran from National Taiwan University of Science and Technology’s Patent Institute. Dr. Tsai Wen-Yi, an advisor and board member of the Taiwan Technology Industry Legal Managers Association, also participated in the discussion.
Professor Lee began by sharing the motivation behind writing the article and addressing questions about whether NFTs should be directly or analogically applied under “property rights” or “tangible assets.” He argued that NFTs are actually closely related to “intangible property,” such as intellectual property systems, or have similar characteristics. In the latter part of the lecture, Professor Li shared his experiences with academic writing, including topic conceptualization, analysis processes, and strategies for overcoming challenges, encouraging students with his personal experiences.
